Can a Parent Bring a Lawyer to an IEP Meeting?

Every parent wants the best education for their child. For children with special needs, that often means creating an Individualized Educational Program (IEP) with the school. This happens in an IEP meeting that includes the parents/guardians, special education team, therapists, counselors, special education advocates — and if needed or wanted, a lawyer.

Students with disabilities are entitled to a free appropriate public education (FAPE) under the federal Individuals with Disabilities Education Act and New Jersey law. When a student is deemed eligible for special education, an IEP outlines how to give them an individualized and equitable learning program.

Are Attorneys Allowed at IEP Meetings?

Yes. You are permitted to bring representatives who know your child’s unique needs to an IEP meeting, which includes attorneys. However, a lawyer is not required and may not be necessary if the case is fairly straightforward.

Legal Requirements For an IEP

An IEP must include specific information about your child, including:

  • School performance
  • Academic, social, behavioral, and physical goals
  • Necessary special education services
  • Modifications and accommodations that can assist the child in receiving the most equitable education in the least restrictive environment (LRE)
  • Testing expectations
  • Placement
  • Transition services (for older students)

An IEP also must be updated annually to review the child’s progress and make updates or revisions.
